Welcome to KECCEL SARLU. These Terms and Conditions govern your access to and use of the Keccel Service Manager (KSM), our cloud-based messaging gateway. By registering for or using our services, you agree to be bound by these Terms and Conditions.
KECCEL SARLU is a licensed mobile messaging provider operating in the Democratic Republic of Congo and is directly connected to local mobile network operators.
"Keccel," "We," "Us," or "Our" refers to Keccel SARLU.
"You" or "Customer" means the business entity using our messaging services.
"KSM" refers to the Keccel Service Manager platform.
"Services" include SMS, WhatsApp messaging, and related services offered by Keccel.
"Content" refers to the text or media messages transmitted through our platform.
You may use our Services solely for lawful business communication. By using our services, you agree to:
Comply with all local and international laws (including data privacy and consumer protection regulations).
Obtain all necessary consents from your end-users before sending them messages.
Not send spam, phishing, or unauthorized promotional content.
Ensure that your usage does not violate mobile network operator or Meta (WhatsApp) policies.
If you use our WhatsApp messaging services:
You must have a verified Facebook Business Manager account.
You are responsible for creating, submitting, and using only approved WhatsApp message templates.
You must comply with the WhatsApp Business Policy.
You must ensure end-user opt-in and provide opt-out mechanisms.
To access our platform:
You must provide accurate business information.
You are responsible for maintaining the confidentiality of your API credentials and account.
You must notify us immediately of any unauthorized use of your account.
You agree to pay all charges as outlined in our service agreement or pricing plan.
All fees are exclusive of taxes unless stated otherwise.
Failure to pay may result in suspension or termination of your service.
We collect and process customer data in accordance with our [Privacy Policy].
We do not access message content except as required for troubleshooting or legal compliance.
Customers are responsible for ensuring their own compliance with applicable data protection laws (e.g., GDPR, local DR Congo regulations).
Keccel aims to provide 99.9% uptime but does not guarantee uninterrupted service.
Scheduled maintenance and unplanned outages will be communicated via email or platform notifications.
Technical support is available via [email/contact form/support portal].
Keccel is not liable for losses arising from message delivery delays, failed delivery, or third-party platform disruptions (e.g., telecom operators or WhatsApp).
In no event shall our liability exceed the amount paid by you in the previous 3 months of service.
We reserve the right to:
Suspend or terminate your account for violation of these terms or applicable laws.
Terminate services with 30 days’ notice for any reason.
You may also terminate your use of the service at any time with written notice, subject to any outstanding payment obligations.
Keccel may update these Terms from time to time. Continued use of the service constitutes acceptance of the revised terms. We will notify you of material changes via email or on our website.
These Terms are governed by the laws of the Democratic Republic of Congo. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of courts located in Kinshasa.
